Legal guarantees

A Vypers Vapes product bought in France by a consumer is covered by two legal guarantees under French law.

Legal guarantee of conformity

The seller is liable for any lack of conformity that appears within two years of delivery (French Consumer Code, Article L217-3).

This guarantee is claimed from the seller, that is, the shop that sold the product.

A defect that appears within twenty-four months of delivery is presumed to have existed at delivery (Article L217-7).

The consumer chooses between repair and replacement (Article L217-9). The seller may set aside the chosen remedy if it is impossible or would entail disproportionate costs; the refusal is then explained in writing or on a durable medium (Article L217-12).

The product must be brought into conformity within thirty days of the request, at no cost to the consumer (Articles L217-10 and L217-11).

Failing that, the consumer may obtain a price reduction or the cancellation of the contract (Article L217-14).

After a repair under this guarantee, the guarantee is extended by six months (Article L217-13).

Guarantee against hidden defects

The seller is liable for hidden defects that make the product unfit for its intended use, or that reduce that use so much that the buyer would not have bought it, or would have paid less, had they known of them (French Civil Code, Article 1641).

Action must be brought within two years of the defect being discovered (Article 1648).

The buyer may either return the product and have the price refunded, or keep it and have part of the price refunded (Article 1644).

Purchases outside France

For a purchase made outside France, the guarantees depend on the shop’s country and on your country of residence: the shop that sold the product tells you which apply.

The shop that sold the product is the first point of contact.
